However, the statutory accident insurance coverage has strict limits.

According to a bill currently under review, starting January 1, 2025, “telework” will replace the concept of home office, allowing work to be conducted in a café, hotel room, or park. These adjustments respond to the desire of many employees for greater flexibility in choosing their workplace. However, it is important to note that the potential locations for telework must be agreed upon in writing between the parties to the employment contract.

An important innovation concerns the so-called “commuting protection,” which covers legal accident insurance on specific routes outside the workplace. In the future, routes to and from telework will be protected if the telework location is: (a) at the primary or secondary residence, (b) in the home of close relatives, or (c) in so-called “coworking spaces.” However, the latter two telework locations are only covered by commuting protection if they are near the employee’s home or regular workplace, or if the distance from the home at least corresponds to the “usual commuting distance.” Also routes to restaurants or supermarkets are only insured if they are in the immediate vicinity of the telework location.
